Does Texas offer a Diversion program for first time DWI offenders?

Some prosecutors in some counties in Texas, believe it or not, will on occasion under certain circumstances offer a person charged with a DWI a pre-trial diversion. However, with that said, there is no set written program or writen law that requires prosecutors throughout the state of texas to offer a pre-trial diversion in any certain DWI case. It strictly depends on what county the person is charged in with a DWI, and the philospy and/or policy of the prosecutors in that county. I hope this makes since.

Texas does not offer any type of deferred adjudication or youthful offender reductions for DWI's.

The only deferred adjudication that is offered is if you are charged with DWI with a child in the vehicle under 15. And that charge is a State Jail Felony.

There are some counties that will offer pretrial diversion.

The best thing you can do is hire a good DWI lawyer to evaluate your case so you can have the best representation possible.
