Legal Question in Family Law in Texas

My 4 year old son's father is paying child support but my son has my last name and his father is not listed on his birth certificate because his father was not present at the time of his birth. He recently sent me papers to have my sons last name changed to his. My question is this by me consenting to the name change will I be giving up some of my parental rights and will he be able to take my son from me laster on as he gets older. We were never married but get along fairly well.

I would not sign any papers until an attorney reviews them for you.

If he is paying child support, then odds are his parental rights have already been established. I assume you went through the TX A G system. You should have a set of these papers or get a copy from the TX A G. Take them to an attorney to review.

Anyone can sue you for custody of the child at any time -- you will have to appear in court and defend yourself. Just because someone sues you does not mean they win.
