i had an affair and i got pregnant, my child is now 9 wks and i dont know whos it is, my husband took full responsibility and gave her his last name but now the other man who i had the affair with is asking for a dna test and wants custody and rights of my child. my question is if this man who i had the affair with takes me to court can he force me to a dna test and can he get custody rights? and where does all this put my husband given the fact that he has been responsible for everything from hospital bills to buying everything necessary for the baby?

Yes, the baby's father can go to court and can get an order for you to take a DNA test. If he is in fact the biological father, he can ask the Court for custody.

The biological father could be ordered to reimburse your husband for expenses associated with the birth of the child. It's up to the judge.
