Legal Question in Family Law in Texas

Child support payments out of state

I am ordered to pay child support in Texas. I am relocating from TX to California. What specifically do I need to do before leaving TX? What should I do upon arriving in the state of California? I will immediately seek new employment. Will my child support payments increase? Is it necessary to fill out new child support papers in CA or will my new employer handle the paperwork? Please help, I want to do the right thing, I'm clueless in this matter.

Re: Child support payments out of state

Your child support remains the same until someone asks for the amount to be modified.

Therefore, if you leave your current employer, your child support remains the same until modified.

Say you are ordered to pay $1,000 per month.

Then you MUST pay $1,000 per month. Even if you are unemplyed. The amount stays the same until someone files a document to modify the court ordered amount.'

You need to pay your court ordered child support thru the TX A G office in San Antonio.

DO NOT PAY YOUR EX-SPOUSE DIRECTLY -- IT IS THEN CONSIDERED A GIFT! IF IT'S A GIFT THEN IT CAN BE TREATED AS IF YOU DID NOT PAY YOUR CHILD SUPPORT.

PLEASE PAY YOUR CHILD SUPPORT THRU THE SAN ANTONIO OFFICE.

Please make sure to keep track of each payment -- many, many times the office loses payments due to a typo!

The burden is on YOU to prove the payment was made.

I once had a man prove that he'd paid over $100,000 in child support that the San Antonio office sent to the wrong person due to a typo!

'

Keep all paperwork until the kid is over the age of 22!

Good luck!
