Legal Question in Family Law in Texas

I have my uncle's son whom I have had since 5 months (he is now 14yrs old). The mother had no problem signing the waiver of citation for custody, but the father (whom been in jail all of his life won't sign the waiver. He is not on the birth certificate. Do he have be involved since he has never done anything for the child. Where do I go from here. I already filed a non-contested petition with just the mother.

The father has to be involved because he is a parent. You will have to file a petition against the father and get him served in prison. Good Luck.
