Legal Question in Family Law in Texas

custody

In my original divorce decree it states that I have to live in Harris County or five surrounding counties. It has been 1 1/2 years since the final divorce. I want to move to another state & do not know if I have grounds???

Your question is not a simple one to answer.

If the father visits the child frequently and he objects to the move, then the court might restrict the child (not you) to the counties listed in the divorce decree.

If the father does not object to the move, then it's not an issue.

The Court would also look at how far away you are moving, the cost of airline tickets, the age of the child to fly alone and the easy access to airports.

If you live more than 100 miles apart, then the father would get approx. 42 days in the summer and every spring break.

If there are extra costs in your moving so far away, the court might reduce his child support so that he can still afford to visit the child. Or the court could require you to pay all transportation costs.

As you can see, your question raises a number of additional questions.
