Legal Question in Family Law in Texas

my daughters father is trying to get her from daycare.. he has 2 older kids that the grandmother has custody of.. and another he rarely sees.. behind on child support by a lot.. he only wants to see her when he has time and its convient.. what can i do.. he wants to take her and not tell me where he lives.. i dont trust him he has never had her alone

It sounds like there are court orders in place concerning her custody and care. If he has not done any of the things in the court order that he was obligated to do then you need to go back to court and have him held in contempt of court, which usually means jail time until he pays and does what he is obligated. The order probably provides that he has to give you updated information concerning his residence etc. Follow the court order where is discusses custody of your daughter exactly. If her father is supposed to see her for 2 hours on Wednesday evening and does not come and pick her up for her visitation then he doesn't see her. The days and times are explicit in the order and should be followed but if he doesn't do what he is supposed to he doesn't get to choose other days and times. Give a copy of the order to the daycare. They are also obligated to follow the order and call the police if the father shows up and tries to take her.
