Legal Question in Family Law in Texas

My daughters father has a modified order, which he has yet to take part in. He didn't show up to court for that or paternity testing so the judge "established paternity" and since he was default gave everything we requested. He hasn't seen her in a year now and had only seen her maybe 5 times before that. He has contacted me once requesting to see her on a day that was not his. I have tons of receipts from the meeting spot and he has never shown can I terminate his rights? My husband would like to adopt if possible. But even if that were not possible could we still per sue termination. And he owes 5000 in backed child support.

It sounds like termination and step-parent adoption might be available to you. Meet with an experienced family law attorney and discuss in person. It appears that you are in the Houston area, if so, these cases are slow. Social study and criminal back-ground check of step-dad must be done. Look on this website and avvo.com for an attorney.
