divorce settlement

At the time of my divorce in dallas 10 years ago my ex wife was allowed to live in the house until the youngest was 18. Which is now.

The decree states that I get 6500 off the top due to her taking some funds.Then foundation work and then a 50/50 split. She thinks I get 50% based on what the mortgage was at time of divorce. My decree makes no mention of this. Have you ever heard of this.

Your decree was issued by a Texas court and will likely be the controlling document. You should seek the assistance of a Texas attorney in the Dallas area.

Sounds like your decree was maybe ambiguous on this subject. Usually the equity goes to the one making the payment. If she made the payments on the house, she would probably get the equity from the time of divorce 'til now. Most likely, your share would be calculated on your equity in the value of the house at the time of divorce. My response is based upon the limited information in your inquiry.
