Lied about gender

My sister just found out her husband is not really a man, are there any legal actions that can be taken on this, I mean it went as far as his family actually showed up at the wedding and lied for him, she just found out through a custody case involving his kids that well weren't really his kids, where the mother of the children is using this as her defense to get full custody of his kids, but he is trying to get her to use his lawyers and not tell anybody anything. Can't he/she go to jail for this? Also can the marriage be anulled base on this?

Your sister needs to contact a TX attorney in the county she lives in to discuss annulment.
