Legal Question in Family Law in Texas

I live in Texas and just found out that my ex is serving me divorce papers in the next few days (which we had talked about and is fine) but he is also trying to get custody of the kids (we live about 4 hours apart). The are special needs kids and at the moment I have one and he has one (long story but the gist is that he was rather physically violent to the child I have). He is living with MY mother and hardly sees the child that is there with him. My mother is the "parent." I was in the process of seeing about bringing my daughter back to me to live since he is an alcoholic and not taking care of her anyhow. So now I do not know what to do or where to go or who to talk to about him trying to get custody of both kids. There is a lot of back-story to this, but I am trying to keep it as simple as possible in this question. I just don't know who to talk to, where to go.....

Hire an attorney in your county that handles a lot of family law cases. Look on this website and on www.avvo.com for an attorney.

It does not appear that you have been served yet.

He can ask for custody but that does not mean he will get it. He can ask for "the moon" but it does not mean that a judge will agree.
