Legal Question in Family Law in Texas

I moved away from an alcoholic husband from MD to TX 1 year ago with my 3 children and he filed for limited divorce/sole custody that is pending court hearing. How soon can I file divorce/custody here in Houston & which will take precedence?

You already have a problem if the case is already pending in Maryland. You could have filed a SAPCR immediately upon arrival, and joined it to a divorce action after 6 months. I do not know Maryland law. Under Texas law, your husband's 'first to file' in a Maryland Court, may limit Texas jurisdiction over the divorce and the property. You need to speak with a Houston attorney immediately - the issues of child support and conservatorship still need to be addressed.
