Legal Question in Family Law in Texas

My ppwk states that Christmas my young kids are with their dad from the day school ends to the 28th...can this be changed in the ppwk before I sign. My attny told me that this has to be agreed to by both parties but why can't it be a negotiating point? Also I was told the law recently changed and now even though I am the primary when my kids dads time of possession is over I have to pick them up. I thought he had to provide all transportation.

Yes, basically all parts of a custody arrangement are negotiable before you sign, including the date that the kids are picked up by the father. The Attorney may be offering you this advice because it is the best option given the particular circumstances of your case. Sometimes a person is better off to compromise on certain issues, than to have to pay to bring a case to court over a smaller disagreement. In Texas, there is not obligation for the non-primary parent to do the transportation. It is simply a term of the case that the parties will have to negotiate.
