Legal Question in Family Law in Texas

Hi there, my question is as follows:

I am a key witness in my brother's custody court, his ex abused the children. Long story short, my brother won the case, but she appealed, we had a court scheduled June 25 but the other party went for a continuance. No court was scheduled following that one. My wife and I bought tickets for our vacation on June 2. The other party just recently informed us they motioned for a new hearing on August 9 but I will be out of town on vacation, I actually fly in that evening. My brother's attorney informed me that we can not ask for a continuance because the other party waited till the last possible moment to issue the court date, he says the days already ran out to ask for continuance. My question is what do I do now? Should I not leave for vacation, which sorry is bull crap. Do I have fork out my own money to reschedule my flight and cut my vacation short? How is her attorney able to get away with waiting till the last possible moment to schedule so there would be no continuance? I guess what are my options? As I stated this vacation has been planned since early June.

Call the court coordinator for the specific court the case is before and ask how the judge normally handles situations like that and what options you have. The court coordinator is responsible for scheduling hearings.
