A notarized document from your daughter does not give you legal custody.

Immediately make an appointment with a family law attorney in your area to try to see if you can get legal custody. Time is of the essence so move immediately -- don't wait.

Look on this website and on www.avvo.com for an attorney in your area.

I don't know why you gave the man the child if he is not on the birth certificate and there is no court order. This man is "legally" a stranger to this child -- he has no legal standing based on the limited facts you presented. If no DNA testing has been done then he might not even be the real bio dad -- happens more often than you think.

Good luck!
