What rights do I have as a grandparent while my son is incarcerated.

Maybe none, but maybe some. Grandparents rights are complicated, and ordinarily governed, in a general sense under chapter 153 of the Texas Family Code. Standing is determined by the child's current circumstances and each parent's conservatorship rights at the time. It is also limit whether you can file an original petition, or only intervene in an existing lawsuit. As you can see, it is a complicated case, and requires an experienced attorney to examine your situation as well as all off the orders and pleadings already on file.
