Legal Question in Family Law in Texas

It says if you or the spouse doesn't live in Texas to fill out an out of state party affidavit.. But when I fill it out do I have to fill out my information as the petitioner or my spouses info since he's the one that's out of state.

I have no idea what you are talking about.

It sounds like you purchased an on-line divorce kit.

In Texas in divorces we don't use affidavits.

The basic divorce is a

1. Petition for Divorce

2. Waiver of Service by other side

3. Final Decree of Divorce

4. State required, Bureau of Vital Statistics form completed

If you are doing this yourself, then use www.texaslawhelp.org - those are the best free forms that I know of.

If you cannot figure it out, then talk to an attorney in your county for help.
