Legal Question in Family Law in Texas

The woman I have 2 childen with has a court order from new york dated 3 yrs ago stating she has custody, however after the order we got back together and moved to texas and share the same house with our kids (for 3 years). She is threatening to take the kids and leave, do I have any legal right to the children...can I stop her? What can I do?

Now that you have lived in the home with the children for three years, you can argue that there has been a substantial change in circumstances such that the original custody order should be modified. You will need to hire a lawyer to file a modification suit. Your lawyer will file for emergency temporary orders so that she does not just take the kids from you. You do not have any legal rights aside from what the court originally ordered until you get your order changed in court. Best regards to you, sir.
