Legal Question in Medical Leave in Texas

FMLA Days being held against me in Incentive Program

My company has a compass point program which allows an employee to take a day off with pay if they have perfect attendance. I am currently on FMLA, but my supervisor is counting the days I am off on FMLA against my attendance. Is this legal?
