Who is responsible for a accident, Owner or driver?

My vans was parked in front of my house, when a car hit one of them and knocked it into the other. The driver was 18 years old with no driver license and no insurance. The car he was driving belonged to his mother and had no insurance on it. I have to take them to court to get the damage fixed. Who should I go after for the damage,the mother or the son.

Either one or both. If there's no insurance and they have no assets, you may get a judgment against them, but be unable to enforce it. If the damage is below $5,000 go to JP or small claims Court, if over that amount you will need to go to a County Court at Law or District Court. Call your local Bar, get the name of an attorney from the referral service, and for a small fee you can take all of your information in to the attorney and get his or her opinion on your chances.
