Legal Question in Civil Litigation in Texas

slander of my company by Fox News

I currently own three day care centers name Candy Cane Corner. The name is registered in each county. I previously owned a center in Waco under the same name. The owner chose to keep the name. Last week Fox News ran a story on their website about neglect in child care centers. They illustrated a story of neglect about two children walking away from the center and being found an hour later. They stated the name of the center (Candy Cane Corner Child Care Center) but did not reference that this was in Waco or who the owner of the facility was. This has already damaged my reputation with my other 3 centers (in other cities) and my other child care management business. I have had several people ask me which of my centers did this happen in.

You should have an attorney contact Fox to get them to clarify it on the site you you can point your customer to that clarificataion. I could also look at your options on the name issue, which you should also address. I grew up in Waco but moved at age 12.

Follow Mr. Nance's advice. What happened is the risk you take when you let someone use your name. It's not slander or libel, since it's truthful. If Fox News fails to add the information as to ownership, you may have a 'false light' case against them.
