Legal Question in Immigration Law in Texas

Abandon by nigerian spouse

My husband, a Nigerian citizen, abandoned me and our two son over one year ago. He now lives in Ohio and refuses to come home. I've discovered that has transferred his immigration case to Ohio. He has attempted to file divorce. He is asking for residential custody of our son and spousal support from me. I'm afraid that I may never see my child again if he has any custody or even unsupervised visits. I have never been invited to INS for an interview. What can I withdraw all petitions to INS? What advice can you offer?

Re: Abandon by nigerian spouse

You need to IMMEDIATELY notify USCIS of this situation and advise them that you are withdrawing the petition.

Have you been served with a divorce lawsuit? If not you should file for divorce immediately as well. This is the residence of the child, and you need to get it filed here.
