Legal Question in Immigration Law in Texas

i have h1b from 99 to 2002 .used for 15 months.then applied for new h1b in 2004.on h1b in the usa since dec 2004 to 2011 dec.left to india for 2 years .back in us now , can i use my un used h1b portion of 99 to 2002 h1b and apply for cap exempt h1b now?
