Legal Question in Insurance Law in Texas

is it legal for the insurance company to total out my car and only give me $4,000 for my car when i owe $12,000 on the note even when the person they insured hit me and was at fault?

Obviously not... get a local lawyer up there!

Most will take this on contingency fee. I guess the adjuster just wants your car?
