Legal Question in Intellectual Property in Texas

I have signed a contract with associate, co-writer, but my associate has not perforned any of the tasks he said he would perform. Can this be titled breech of contract, and make nill and void all agreements and validity of contract ?

I wrote the movie script in question, and registered copyright before even meeting assc. in my name,

exclusive rights owner.

He signed cowrite, and producer. I have checked his company name-title, and as of now it is non-

existant. He does not have even the $ 3500.00 to begin hiring the financing search team.

What should I do ???

What you could do is send your associate a letter (anticipatory repudiation) asking for an explanation of his/her lack of performance. In the letter you can specify that if you don't hear a response in a reasonable amount of time and your associate does not cure, then you are excused from your duties and the contract has ended.
