Legal Question in Medical Malpractice in Texas

If a pulmanologist misdiagnoses you with emphysema for a term of almost two years and then runs a diagnostic test that shows there was no lung disease after all the treatments and medications..and now I have several medical issues that have to be monitored every 6 months by CT SCANS.. is it possible to sue for that misdiagnosis? The pulmanologist that diagnosed me waited almost 2 yrs. after the intial diagnosis to order a test that I was told by other doctors should've been done BEFORE I could have been diagnosed by my pulmanologist. It was not done until recently..only to discover he was WRONG and I do NOT have a terminal lung disease and I never needed those meds. During that time I was sent to a cardiologist for chest pains to examin my heart for damage, as well as an ENT to be checked for Throat Cancer because I was losing my voice on the meds. Then two nodules showed up in the right side of my neck after..and one on my lung as well and now one on my right ovary, and one on my right breast just recently. I personally believe all of these have something to do with the misdiagnosis and the medications they were giveing me during that 22 month period. I am very angry! I was terrified of dieing from complications of the Emphysema my doctor was telling me I had all this time only to find out he made a mistake. I even had joined a support group for emphysema patients since there is no cure. Now he claims I never had Emphysema at all. Of course, I can't help but wonder if the nodules that have showed up since the treatment started for my supposed lung disease are related to those treatments for something I never had! Please let me know what I can or should do about this. It was a horrible experience and very costly too. I am in the process of losing my home now and have been off work for over a year because those meds had made me so sick. I lost so much wieght while on the meds. Since they discovered the misdiagnosis, and they took me off of the meds I have gained my weight back. I am now 113 lbs.! I am still having alot of pain due to the cysts or nodules I now have though. Where do I go from here? No offense but I don't think I will EVER trust another doctor again. I have lost everything feels like only to find out that if my pulmanologist had only run the proper tests in the beginning..none of this would have happened. The Dr. made a mistake and all my money went to meds, and Ct Scans and other specialists that evidentally I didn't need all this time. Any advice would be considered greatly appreciated. Thank you for your time! Sincerely, Shari Loehr & Family

I'm sorry to hear you've been involved in such a horrific situation. You need to consult with a Medical Malpractice attorney ASAP. You have a limited amount of time to file a lawsuit and with tort reform, med mal cases are more difficult to pursue. I would be glad to speak with you about this and evaluate your case. My number is 512-751-0680. Call anytime.
