Legal Question in Personal Injury in Texas

I was in a bad car accident a week ago, and had to be transported by ambulance to the local hospital. I was coherent the whole time I was being cut out of my car, and was able to respond to the officer on scene as well as the EMTs. While in the emergency room, I was restrained on a backboard until x-rays could clear me to move. While waiting, the officer came in and took my statement, and then told me the collision was my fault. At that time a nurse came and said more x-rays were needed, and she invited the officer to come along; he declined and said he would come to my home to talk to me after I was discharged. I was given the go ahead to go home after four hours, along with a prescription for pain medication. My fiance took me to the pharmacy, where I was asked for my identification. I went to get it out of my purse only to find it was gone. The officer must have taken it out sometime between the time the accident occurred and the time he came to see me in the emergency room, but he didn't say anything to me!! One week later, and I still have not seen or heard from the officer find out whats going on or to get my license back. Is it legal for an officer of the law to do what he did, and also is it legal to issue a traffic ticket a week after the incident?

Yes. Send written letter to police requesting copy of your DL back. Sometimes it takes time to investigate an accident.

Call and write to the Officer. Your zip code does not appear to be TX. However, do not take the officer's word for whether you have a valid claim. Talk to a lawyer about it.
