The insurance company should know this (it will need to be proven) but you should NOT be talking with the insurance company.

Insurance companies are businesses. They are motivated by profit/money. They have NO interest in being nice or helping people who have been injured. That doesn't mean that they are evil or bad; that is just what a business does. Insurance companies have professionals to talk to you to try to devalue your claim and try to make it look like the accident was at least in part your daughters fault.

I have represented several people hit by drunk or impaired drivers. This is a special kind of case that requires a unique approach.

When I was 10 years old my family and I were in a vehicle hit by a drunk driver. I fight for the victims of DWI /DUI all over Texas...

This is not a "do it yourself" situation. Do not do this case yourself under any circumstances. Get an attorney who handles injury cases involving DUI/DWI defendants. Most injury attorneys will meet with you and discuss the case for free (myself included)

If you don't use an attorney, I can guarantee you will mess this up.
