Legal Question in Real Estate Law in Texas

How can I keep my home

I baught a home about 2 years ago and my boyfreind co-signed for me because I did not have enough income. He moved in with me and helped with the bills. We are having problems and he refuses to leave and insist that it's his house. I've offered to sell the house to him but he cannot purchase the house because he is not creditworthy, and he refuses to sell the house because he wants it. What can I do legally to get out of this mess. I hate to loose my home and I have 2 kids. I was told that I can get a divorce in the state of TX because we are common-law married....is this true and how can I proceed, all I want is my home.

Thanks in advance for any advise you can offer

Is he the father of either of the two children? You can file for a divorce through the court system. Which county are you in?
