What is the difference between a trust and a will

A Trust protects assets and can distribute assets to yourself while you are alive, and then, to other individuals, after you pass away, if the Trust is properly set up and funded with your property. A Trust can avoid the litigation Probate process, which is a costly process.

A Will only states what you want certain individuals to inherit and includes schedules of property and then, if that property still exists when you pass away, it is distributed by the Executor or Representative appointed by the court and usually named in the Will.

Upon your passing, the heirs in your Will, will need to go through Probate litigation process in order to transfer your property.
