Legal Question in Wills and Trusts in Texas

many issues w/o will

Father of 7 adult children dies w/o will (note:1st wife deceased). He solely purchased a ranch w/a home and another home in the city. 5 years later (after purchases), he meets and remarries a woman w/3 children, now adults. At present one child of the deceased father, one step-child and spouse all live in same home and it--name removed--not working. Who is entitled to what property? who can continue living in the ranch home? and they all lived there prior to the fathers passing.

Also there was another piece of property purchaed while they were married, but the spouse owes 2 more payments and claims she will be giving it to her boyfriend to build a home. Is that her right also?

Go to our website, http://www.bradie-law.com and take a look at our table of distribution in the event of intestacy, with children of the marriage, not of the marriage, separate real property (bought before the second marriage) and community real property (bought together during marriage) and you can see who gets what share.

Obviously #2 can't give away property that belongs to others, since all she can give away is her undivided portion.
