Legal Question in Wills and Trusts in Texas

ex living in home owned by ex-wife

I recently ask a question which was answered. I now have another problem that came up recently with a will that is waiting for a court date for a hearing. Has been to probate and was contested by ex-husband of my deceased daughter. They were divorced for 5 years but he lived with her until 2 months before she passed away and moved out, buying himself a new home. She received the home and car in the divorce and he received their business they owned together while they were married. I'm her mother and she willed her entire estate to me. I live in WI. It was probated in Nov. 2005 when it was contested by the exhusband and still waiting for the court date. Why is this taking so long? I was(mother) paying all expenses on home, electric, water, house insurance, etc. and all of a sudden I find out the exhusband has moved into her home and it hasn't been to court to prove his ''commonlaw''rights which he is contesting. I feel that is the reason there is a ''hearing'' or court trial to prove this. What right does he have to move in the property when it is not ''legally'' his at the time. Is this legal or do I have recourse to do something about this? I am very very upset as I feel I don't have any say in a matter where I am involved. Can you help
