Legal Question in Wills and Trusts in Texas

My mothers nursing Home & Medical Records

Mother died May 16 2008. She had no property,no Will, no Power of Attorney. I am listed on her death Certificate as her daughter. I'm The oldest girl. I would like to have copies of her Nursing Home Records & Medical records. The nursing home told my brother only a power of attorney or guardian could get copies. What can I do?

You are going to have to open up some kind of legal action, e.g. a lawsuit or a probate in order to subpoena the records. I guess the next question is - why can't I get my mother's records? Because she did not authorize you to have her records either while she was alive or after she passed away. Good Luck.
