Legal Question in Wills and Trusts in Texas

Power of Attorney

Our father has fallen ill and only has a short time to live. Our stepmother has filed for power of attorney. Is there any way to give that right back to us?

Re: Power of Attorney

1. Only your father can grant a power of attorney over his affairs.

2. It sounds as if your stepmother is filing for a guardianship of your father.

3. The courts usually prefer the spouse over the children in matters such as these.

4. If you had a power of attorney over your father's affairs, that power remains in force until he revokes it in writing.
