to probate a will with only one heir, do you need a lawer? This is in texas.

The answer depends on a few items:

1. If you are probating the will as a muniment of title only, and the will conforms to all of the statutory requirements, then you may be able to probate it without a lawyer.

2. Some counties have taken the position that probate a will and asking for letters testamentary is akin to representing someone, therefore you would need a lawyer.

The upside is that if the will was properly executed, then the probate procedure doesn't have to cost too much, even with a lawyer.
