Legal Question in Employment Law in United Arab Emirates

I hve been working with an insurance company, purely on commission basis since 2004 in Dubai. On 19 th Aug 2010, I went for a vacassion back to India for 10 days. And because of some inevittable reasons I had to extend the leave till 30th Oct. As my daughter was not well I requested to extend the leave for 10 more days from 30 th, i.e up to 10th Oct. But unfortunately I got Air ticket only on 17th Oct due to the cancellation of many flights from my place to my work place. Mean while I got a termination letter from my company on account of unauthorized absence from work, dated 6th September. I would like know- Is this a legal action? Will there be any ban for me from searching other jobs?

Am I eligible to obtain any compensations from the company?

In my contract my salary is mentioned as AED 1500/-pm, but no salary paid so far.

I presume you are still in Dubai. A proper reply can be given to you only after seeing the copy of your Labour Contract and also your termination Letter.

However from the available information furnished by you, it has to be presumed that you would be eligible for terminal benefits from your Company. As regards ban, it has to be seen as to whether your Company has reported you as an absconder to the Labour Department, which may lead to a ban upto 1 year. Otherwise you would have 6 months ban, which can be lifted upon producing NOC from your Company and also depending on your category of employment, further your educational qualification would also be looked into.

For further clarifications, you may mail to [email protected] or call on 050 2104389.
