child custody

i am thinking of taking my children to spain to live there. they have not seen thier father for almost 2 years.the children do not wish to see him and the courts agreed with the children. do i still need his permission or the courts.

If this father has parental responsibility for your children, either his consent or leave of the court must be obtained before you remove the children permanently from the jurisdiction of the UK courts to live in Spain. The fact that he has not had regular contact with the children will doubtless persuade a court to grant leave but it does not change the position that this leave must be obtained unless the father agrees in writing.
