Legal Question in Criminal Law in Utah
My husband I have charges already (he has 2 for retail theft and was placed on zero tolerance, I myself have 1 retail theft charge and am on informal probation). just a few days ago, we got caught with weed, and got charged for poss of less than 1 ounce and for paraphernalia. My question is, is there a chance of us going to jail? I hope not.. and if so, how long?

Probation is an agreement that you made with the state that they would suspend the jail time if you followed the terms of the probation. Since those terms were violated with this new crime they could reimpose jail-time. They could also impose jail-time on the new charges. There are a lot of factors that can determine whether or not they will impose jail-time. It would be a good idea to get a hold of an attorney to help you with your issue.
