Legal Question in Family Law in Utah

child custody

I have been divorced for over a year. My two sons want to live with me when I purchase a home near their school this coming spring. The divorce has been very amacible and without incident or problems. The ages of the boys is 14 and 12. The boys and I have always been close and we are both tired of only seeing eacother on weekends and at soccer games. My questoin is, can they live with me full time? Will I have to sue for custody or are they old enough to decide. Both me and my ex-wife are good and stable partents. What is the age when these boys can decice on their own to live with me?

Re: child custody

You children have a significant role in deciding when and how long to be with you. The best solution is for you and the ex to decide on a new plan, then get a court order. You must get a new court order or you could (innocently) be violating the law. If your ex does not agree, you can return to the court and the judge will evaluate all of the facts, including the preference of the children.
