Legal Question in Family Law in Utah

I am a man recently separated from my wife but not divorced. I have partially moved out and my wife is trying to only let me see my son every other weekend and every Wednesday like we were already divorced. Can I see him more often?

Until there's a court order to the contrary, you have just as much right to see your son as your wife does. Just because you've moved out doesn't mean she now has "ownership" over your son and can dictate to you as to when, whether and under what circumstances you may see and spend time with your son. I would strongly advise you to retain an attorney if you are planning on going through with a divorce. You will be able to get temporary orders put in place in your divorce case establishing custodial and visitation rights that will need to be followed. I offer a free initial consultation if you would like to contact me to set up an appointment so we can discuss your matter further. You may call my office at (801) 274-3100 and schedule an appointment to meet with me.
