Legal Question in Insurance Law in Utah

Life Insurance and Mortgage

I am the Executor of my father-in-law's estate. His Life Insurance was not included in the trust. His house has a mortgage and a lien against it. My question, does the insurance money need to be used to pay his mortgage?

Re: Life Insurance and Mortgage

The assets of the estate are to by used to pay the mortgage. If the estate does not have cash assets, you will have to sell property to pay expenses - including selling the house. Life insurance goes to the beneficiary and is not included in the estate unless the estate is named as beneficiary.
