Legal Question in Real Estate Law in Utah

6 years ago I keyed an ex-boyfriends car while I was intoxicated. Now, I'm in AA and since he still emails me I made a 9th Step Amends to him and admitted that I did it. I haven't been returning his emails lately so he's mad at me and now he's threating to sue me for the cost of the damages to his car. Can he even do that?

The apparently applicable civil Utah statute of limitations is found in the Utah Code at UCA 78B-2-305(2), which says:

An action may be brought within three years:

(1) ....

(2) for taking, detaining, or injuring personal property...

So because it has been more than three years that if he does sue you, you can raise the statute of limitations as a defense.

Or you can follow he 9th step amends and pay him at least something. Taking responsibility is never a bad thing.
