Legal Question in Real Estate Law in Utah

warranty deeds and trusts

My ex-husband just recently transferred his house deed from him to a trust in his name. He owes me a lot of money in child support. I do have a lien on the house for the amount due. Does this mean that the home is protected from the lien now? Also where did he file the trust and where can I get the details of it?

Re: warranty deeds and trusts

The transfer does not void your lien - it is still valid. You can foreclose on the deed, and force the sale of the house. You can be paid from the proceeds of the sale. You will need an aggressive attorney to get your money. You may call for a free consultation.

PS In Utah trusts are not recorded.
