Moving a Custody Case from Connecticut to Vermont

My wife's ex-husband, fomerly a Connecticut resident, now lives in New York. My wife and her kids have now lived in Vermont with me for 4 years. The ex has expressed that the 15 year-old child come live with hime in New York City. I would like to move the proceedings to Vermont. Is this possible?

Hi: In general, child custody proceedings under the

Uniform Child Custody Jurisdiction Act (UCCJA)

are held in the location where the children are

located. It is a little more complex then that and there

are various exceptions. I assume that your wife has

custody of the children and that there are no

allegations of abuse, etc. Since the children have

lived in Vermont for more than 6 months, a Vermont

court would probably take jurisdiction.
