Legal Question in Business Law in Virginia

business trademark

I want to use the business name ''Running in Choos'' for my stylist business, will there be any legal issues with this b/c of the big retail shoes designer Jimmy Choo? Also to protect myslef should I set it up as a sole prop or a LLC?

Re: business trademark

This very well could involve a trademark infringement, and I would advise that you speak directly with an attorney to fully protect yourself and business in connection to selecting your business name. Also, with respect to whether you should be a sole proprietorship or llc, operating as a sole proprietorship, while cheap and quick, does subject you personally to all debts and liabilities of the business. An llc should shield you from the company's liabilities; again I suggest contacting an attorney directly to determine what business vehicle works best for you.

Re: business trademark

However, if you're the only member/shareholder of your proposed LLC, you would likely have the same liability exposure as you would have if operating as a sole proprietorship.
