Legal Question in Consumer Law in Virginia

New car sale fraud

Bought a new car 10 years ago.

Yesterday when having work done on

the car, an auto repair shop told me

my car had been in a previous wreck

because there was extensive body

work on the door and possibly other

parts of the car.

I have never had body work done on

the car. The dealer 10 years ago sold

car to me as a brand new car. Dealer

is still in business. Any recourse?

Re: New car sale fraud

Unfortunately, I would suspect that whatever statute of limitations that might be applicable to this situation would likely have already expired.

Re: New car sale fraud

You can certainly try, but it will be difficult. You could argue the statute began to run from the point of the recent discovery of the fraud. The extent of the damage will be an issue. You would need to check CARFAX.com and the title history with DMV and have an attorney assist you. Good luck.
