I loaned someone some money that he is basically refusing to pay back. What recourse do I have and what documentation will I need?

Virginia Small Claims Court is likely your best remedy. You can sue this person

there for sums up to $5K and the rules for procedure as well as

evidence are considerably more liberal than what you would find in regular

generaL district court. Furthermore, no lawyers representing clients are allowed.

Almost any evidence having any relevance to your claim is likely to be

admitted in your case by the court hearing the matter and any items such as

emails to you from the defendant referencing the matter, any promissory notes

(no matter how informal ) evidencing this loan or testimonial evidence from persons who have personal knowledge of your loan to the defendant in the

form of affidavits, any or all of these as well as other evidence could be very helpful in winning your case.
