Wow -- sounds very frustrating.

In terms of criminal action, you would need to swear out a warrant or call the police. Your question covers far too many topics to easily answer. However, you can research this yourself! Start by going to Google and typing "VA Code 18.2" in the search box. This is the core criminal statute "tree" for Virginia. Then pick the various chapters that apply to your situation to see the law.

In terms of civil action (that's what we call "suing someone" in lawyer speak), you can sue for a couple of different torts. You first have to establish who owns the property on which you live. If the house or condo belongs to you, you can bring the suit. If the home or apartment belongs to someone else, you must have them bring the suit. There are some exceptions to this, but as a general rule, that's how it works.

Finally, consider a small claims action. In Virginia, you don't need a lawyer to represent you in small claims. As lawyers can be very expensive, you might want to consider contacting Catholic Charities for free representation, or pursuing any civil action in small claims court.

Good luck, and I hope you finally get some sleep!
