Legal Question in Criminal Law in Virginia

Weapon and Drug Paraphernalia Possession Chares

My Son has been charged with Weapons and Drug paraphernalia charges.

I would like to think that he is a innocent passenger/associate.

He was a passenger in his friends car, his friend was driving.

The entered a military base where the car was searched.

My son was the sponsor-he had the ID card to gain access to the Air Base.

He has to appear in court on 13 Sept. facing these charges; he will appear in a civilian court.

Is there a possibility that he will somehow be charged with this?

Is it necessary to seek legal representation or will the Judge charge the driver only?

The driver is claiming that the Butterfly Knife and Pipe smelling of Marijuana belongs to his brother. The items were found in the back seat area of the car on the floor.

Thanks.

Re: Weapon and Drug Paraphernalia Possession Chares

Your son will very defintely need to have competent criminal defense counsel representing him on these serious charges. Therefore, such counsel must either be privately retained or a request made to the court to appoint an attorney in the event that funds are not available to hire one.
