Work Release on 2 seperate charges

My son has 2 charges he is currently serving time for, 1st charge was a felony and was given 90 days and was given work release; however he failed the urine test! Well, while in on that charge he came up on another charge which was a he was given 30 days and also work release. Well, the sheriff department told him he could not have the work release for the 2nd charge becuase he failed the test the first time. Shouldn't the 2nd charge be seperate.. and he should be allowed to take the test again and granted work release for the remaining 30 days?

Work release is a privilege offered by the Sheriff. He has qualifications for the privilege, one of which is that you not fail at it before. I'm afraid my opinion isn't relevant - a judge cannot order the sheriff to accept anyone in his program.
